School Finance
Our corporate and finance attorneys assist educational institutions with a wide range of school finance matters. We assist both public and private institutions in financing construction and capital improvement projects, and in efforts directed at improving and enhancing instructional services, after-school programs and other strategic initiatives, through bond initiatives and tax-exempt and government-assisted, project-based financings.
We recently served as co-lead counsel representing 263 school districts (including HISD) in the successful 2004 litigation that challenged the constitutionality of the Texas public school finance system. The decision found unconstitutional a cap on tax rates that prevented the plaintiff districts from raising additional funds. The decision allows districts to address inflation and increases in uncontrollable costs, such as utilities and insurance, and enables them to attain higher levels of student performance.
