Seth M. Cohen
Seth Cohen is an associate in the trial section of Bracewell & Giuliani's New York office. He litigates a wide variety of complex commercial litigation matters in federal and state trial and appellate courts in the areas of breach of contract, breach of fiduciary duty, fraud, RICO actions, government and regulatory investigations, product liability, insurance recovery, and litigation involving clients in the entertainment industry.
Prior to joining Bracewell & Giuliani LLP, Seth was a managing associate in the New York office of Orrick, Herrington & Sutcliffe LLP. He previously served as a summer clerk to the Honorable Nina Gershon of the United States District Court for the Eastern District of New York.
Before he entered the legal profession, Seth co-founded a nationally recognized online entertainment website for college students and served as an associate producer at ABCNews in New York and as a writer for the National Basketball Association (NBA), Music Television Network (MTV) and VH-1.
Complex Commercial Litigation
Mr. Cohen represents a large international consulting firm in connection with alleged breaches of contract, fraud and RICO violations arising out of an Asset Purchase and Sale Agreement. A Manhattan federal court last year dismissed the RICO claims against our client and remanded the state law claims.
Currently represents a global telecommunications service provider in a breach of contact action against a Japanese telecommunication operator in connection with the construction of a subsea fiber optic network in Asia.
Government & Regulatory Investigations
Mr. Cohen has represented several executives in connection with Department of Justice investigations involving allegations of improper accounting as well as alleged securities fraud and insider trading, and in response to various subpoenas.
Mr. Cohen was part of a trial team representing a component manufacturer in an Alabama lawsuit where 1,400 coal miners alleged respiratory injury from exposure to isocynate-containing products used in coal mines. After Frye motions, in limine motions and jury selection, the case was favorably resolved in September 2010.
Represented a major pharmaceutical company in a series of insurance coverage disputes arising out of mass torts. Throughout his career, Mr. Cohen has represented various entities in insurance recovery actions, including chemical companies, a private equity fund and clients in the sports and entertainment industry.
Represented an NFL quarterback in a tort action in New York Supreme Court. Mr. Cohen briefed, argued and ultimately secured dismissal of the action.
Represented the co-founder of an iconic New York City rock club in settling an intra-family dispute involving ownership of trademarks.
Represented a website in the complete dismissal of federal claims, including trademark infringement and false advertising, asserted against the website in the United States District Court for the Northern District of California.
Successfully represented a weather anchor for a major broadcast network in a contract dispute with the anchor's talent agent.
Represents Jibe.com, an Internet start-up, in all aspects of the company's litigation.
Has represented several students with learning disabilities in actions against the NYC Department of Education for failing to provide academic accommodations and services guaranteed by federal and state law.
Mr. Cohen sits on the Junior Board of Directors of Advocates For Children, a non-profit organization advocating for the educational rights of underprivileged students in New York City.
