Michael Kuhn maintains a civil trial practice in insurance, employment, franchise and commercial litigation, and has handled a variety of civil and criminal appeals in the state and federal courts.
Mr. Kuhn represents insurers conducting business in Texas. A significant portion of his practice is focused on helping clients address disputes arising out of professional liability and property and casualty policies, including coverage litigation and coverage disputes. He also represents property and casualty and professional liability insurers in matters involving coverage, pre-suit negotiated settlements, litigation, mediations, arbitrations and appeals.
Mr. Kuhn's employment practice includes claims of unfair termination and retaliatory discharge claims brought in state and federal court and at the Equal Employment Opportunity Commission. Representative clients include public entities and private corporations. He has negotiated termination and severance agreements and litigated the validity of covenants not to compete.
Mr. Kuhn's franchise experience includes state and federal litigation concerning franchise trademarks, trade secrets and proprietary information, and the enforcement of contested franchise agreement provisions, including covenants not to compete.
In commercial litigation, Mr. Kuhn represents banks in wrongful foreclosure, wrongful offset, and loan default litigation; private individuals in complex trust and securities litigation; energy companies in pricing and take-or-pay disputes; and corporate clients in a variety of contract and fraud litigation.
Mr. Kuhn represents clients charged with white-collar criminal matters, including antitrust and banking violations. Legal services have included grand jury witness representation in hearings and jury trials in state and federal courts. Another aspect of his criminal practice has focused on victim representation. He has also represented corporate clients working with law enforcement authorities and prosecutors to secure a fraud investigation.
Following law school, Mr. Kuhn served as a law clerk in the U.S. Court of Appeals for the Fifth Circuit and was an attorney in the Harris County district attorney's office.
