Marcy Kurtz advises banks and other lenders on creditors' rights issues and represents her clients in litigation, both within and outside of the bankruptcy case context. Ms. Kurtz also provides pre-bankruptcy advice to debtors, including debt restructuring and maximizing use of exemption laws and other safe harbors, and advises corporate clients on bankruptcy implications of various corporate merger and acquisition transactions.
While primarily a bankruptcy lawyer, Ms. Kurtz also handles complex commercial and collection litigation cases in state and federal courts. She has acquired particular experience in fraud litigation and preferential transfer and other avoidance action litigation. Ms. Kurtz has addressed General Counsels from multiple corporations around the US regarding the rising risks for In-House Counsel on various liability issues, including those associated with a corporation's officers engaging in fraudulent conduct.
Prior to joining the firm, Ms. Kurtz served as a law clerk to the Honorable R.F. Wheless Jr., chief bankruptcy judge, Southern District of Texas.
