Laura Herring has over 25 years of experience in general business litigation with a focus on professional liability defense and gas contract litigation. She represents professional service providers in accounting malpractice and engineering liability disputes, directors of financial institutions in breach of fiduciary duty and related claims and a broad range of clients in tort and breach of contract litigation, securities litigation, personal injury defense, trade secret litigation and disputes relating to covenants not to compete.

She has represented accounting firms in lawsuits relating to tax, audit and consulting services involving allegations of negligence, negligent misrepresentation, securities violations, breach of implied warranty, RICO violations, breach of fiduciary duty, fraud and conspiracy. She has also represented accounting firms in disputes with former partners regarding retirement and pension claims. Laura has represented engineering firms in contract disputes and negligence claims.

Laura represents gas pipeline companies in suits involving gas processing disputes, take-or-pay claims and claims by royalty owners.  She has defended oil and gas exploration companies in personal injury defense and toxic tort litigation.

She has represented employers in state and federal court in disputes with former employees involving trade secrets and covenants not to compete.

Representative Matters

Represented accounting firm and audit partner in audit malpractice case involving claims by a shareholder of a former client of the accounting firm.

Represented accounting firm in audit malpractice case in state court jury trial. Case was tried in to verdict and resulted in a defense verdict and a take nothing judgment in favor of accounting firm.

Represented employer in covenant not to compete case where former employees sought declaratory judgment that covenant was unenforceable and employer sought to enforce the covenant; the covenant not to compete was found to be enforceable by the Texas Supreme Court.

Obtained summary judgments in state court on behalf of accounting firm in two audit malpractice cases involving claims of negligence and negligent misrepresentation; also obtained summary judgment on behalf of accounting firm in case involving tax malpractice and in a case involving professional consulting services.

Represented engineering firm in a state court jury trial involving tort, contract and alter ego claims. Case was tried to verdict in favor of engineering firm and judgment in favor of engineering firm was affirmed on appeal.

Represented gas pipeline company in jury trial involving claims of breach of gas processing agreement and fraud. Case was tried in state court and resulted in a defense jury verdict and take nothing judgment in favor of pipeline company; judgment in favor of pipeline company was affirmed on appeal.

Represented oil and gas producer in personal injury case involving claims asserted under the Longshore and Harbor Workers' Compensation Act and Outer Continental Shelf Lands Act.

Represented engineering firm in breach of contract disputes involving claims related to international shipping and construction management.

Represented uranium mining company in toxic tort claims asserted by homeowners, residents, and former employees.
