Kevin Schutte's practice primarily focuses on commercial and business litigation, involving contract disputes, fraud, intellectual property, misappropriate of trade secrets, unfair competition, commercial real estate disputes, environmental contamination, the Texas Deceptive Trade Practice and Consumer Protection Act (DTPA), Texas and Federal debt collection practices, Fair Credit Reporting Act, banking and lending litigation, violations of the Gramm-Leach-Bliley Act, breach of fiduciary duty, and products liability. He represents clients at both the trial and appellate court levels, as well as representing clients at arbitrations and other forms of alternative dispute resolutions.
Additionally, Mr. Schutte has significant experience with enforcing and collecting Texas and foreign judgments. His knowledge and skills relating to the various methods available to judgment creditors to enforce judgments allows him to be a versatile advocate and business counselor.
Representative Matters
Arisma Group, LLC v. Trout & Zimmer, Inc., Tyco International (US) Inc., Covidien, Inc., Covidien AG, Marksmen, Inc., Interbrand Corporation, and Kelly Hardy aka Oliva Lee. Obtained a take-nothing summary judgment for a branding agency and its client in federal court wherein the plaintiff was seeking to rescind a transaction involving the acquisition of a domain name because the branding agency, its client, and the third party hired to secure the domain name allegedly used fraudulent means to lower the purchase price.
Allegro Development Corporation v. ERC Trading AG, f/k/a Crown Resources, AG. Represented defendant/counter-plaintiff in a lawsuit against a software development company arising out of a contract to develop software designed to track prices and financial risk associated with buying and selling crude oil and refined products in Russia and Western Europe.
Cantu v. Dieste Harmel & Partners. Obtained a take-nothing summary judgment for an advertising agency in a multi-million dollar federal court copyright infringement and fraud case involving an allegedly stolen advertising campaign for a national soft drink company.
Corporate Property Associates v. Varo, Inc. Obtained a multi-million dollar jury verdict in an environmental contamination case on behalf of landlord against tenant.
Sunrise Medical Technology, Inc. v. Metro Imaging, LP. Represented a MRI and CAT scan imagining center against its former service provider.
U.S. Office Holdings, L.P. v. Dallas Roadway Products, Inc. Obtained a partial summary judgment and a jury verdict in favor of landlord against tenant.
Ryffel v. LaForge. Represented defendant/counter-plaintiff against his business partner in a case involving misappropriation of oil and gas interest.
Victor Abraham, et al. v. One World Holding, Inc., et al. Successfully represented three board members in an injunction action to block a shareholders meeting to vote them off the board of directors.
In re Holly A. Zeman; Holly A. Zeman v. Thomas Blake Humphreys, Jr., et al. Obtained a take-nothing judgment in an adversary proceeding in the United Stated Bankruptcy Court for the Western District of Texas, wherein Debtor sued client for breach of a promissory note, which Debtor had previously released after filing for bankruptcy protection. Following the release, Debtor dismissed her bankruptcy, but then, re-filed for bankruptcy protection a few months later. Debtor claimed that she did not have the authority to release defendant from the note. After a trial on the merits, the Court ruled that pursuant to 11 U.S.C § 549, Debtor's release was valid and enforceable against Debtor.
