Gregory Nye is a Partner on the Financial Restructuring team, where he focuses on out-of-court and chapter 11 restructurings, with a particular emphasis on litigation assessment, bankruptcy trial work, and bankruptcy appeals. He also handles complex commercial cases in federal and state courts throughout the nation.
Mr. Nye's particular experience is in litigation arising from complex financial transactions, including corporate borrowings, public debt issuances and restructurings, insurance, leasing and other financial transactions. Mr. Nye regularly works with ad hoc committees and other multiple client groups who share exposure in sectors including building supplies, entertainment, telecommunications, airline, food services, public utility, funeral services, timber and various other industries. He provides creative, aggressive litigation services to reach business solutions, either by negotiation, alternative dispute resolution, or trial. Recent trials include the defense of fraudulent conveyance claims against lenders to a national homebuilder, successful trial of valuation disputes in relief from stay and plan confirmation proceedings; judgment for insurance company clients charged with manipulating a public company through certain debt covenants obtained in out-of-court restructurings; successful trial of "make whole" premium claims for investor clients; and successful defense against injunctions sought by a public company against bondholder clients.
Mr. Nye has represented clients in a wide variety of high-profile legal disputes. He has successfully defended cases involving avoidance and other claims by bankruptcy asbestos committees, claims for fraud, misappropriation of company assets, accounting irregularities, as well as the full range of alleged business torts. Mr. Nye has experience in cases involving construction and interpretation of complex financial and insurance instruments.

Litigation in connection with U.S., Mexico, Canada and U.K. insolvency cases.
Successful defense of 10 insurance companies in connection with $400 million claim arising from administration of private placement loans.
Successful coordination of asset recoveries in various bankruptcies, including proceedings in the telecom, food services, airline and funeral services industries.
Trial of contested bankruptcy proceedings, including fraudulent conveyance, preference and plan confirmations.
Successful prosecution of lender claims, including state and federal securities claims and related causes of action.
Defense for investment banking institutions in bankruptcy court challenge to interpretation of Trust Indenture Act provisions in $1 billion financing.
