Evan McCord represents a range of international and U.S. clients in general civil litigation matters. His practice focuses primarily on complex commercial litigation, including contract litigation, energy-related litigation, securities litigation, insurance litigation, and business torts, with additional experience in intellectual property litigation. As well, he has lead associate and second chair litigation experience in state and federal courts across the country.
Evan has broad experience in insurance coverage disputes and bad faith litigation, including life, general liability, director and officer liability, and property and casualty insurance. Evan has also handled a number of Deceptive Trade Practices Act (DTPA) disputes. He represents clients from a variety of industries including: real estate, insurance, energy, pipeline, construction, and infrastructure. He has experience with mediation, arbitration and litigation leading clients through filings, depositions, complex discovery issues, and hearings while working seamlessly with in-house counsel when appropriate.
Representative Matters
Represented a small fishing company in a case involving a temporary restraining order (TRO) and negotiation of final settlement and return of trade secrets.
Represented a life insurance company as second chair in mediations and litigation in federal and state court.
Advised a Texas state bank in loan related issues on interest collection.
Advised a partnership in negotiations with the Texas Department of Transportation regarding the formation and implementation of certain comprehensive development agreements for the construction of various Texas toll roads.
Lead associate in a life insurance policy case involving breach of contract, DTPA and bad faith litigation for over $3 million in claims.
Represented a small pipeline investment company in arbitration proceedings relating to pipeline construction issues; primarily responsible for discovery including on site investigation, witness preparation, and working with experts.
Represented a minority shareholder of a medical services company as lead associate in a dispute involving claims of shareholder oppression.
Represented bankruptcy trustees in litigations involving claims for breaches of fiduciary duty, fraudulent transfers, and director and officer liability insurance coverage.
Represented a Texas real estate company in an insurance coverage and bad faith litigation resulting from Hurricane Ike damage to 23 office buildings.
