David A. Shargel
David Shargel is an associate in the trial section of Bracewell & Giuliani's New York office. His litigation practice focuses general commercial litigation, internal investigations and white collar criminal defense. Mr. Shargel's practice also involves issues surrounding electronic discovery and data management.
Mr. Shargel has litigated complex commercial disputes involving contract, business torts, technology and fraud, and has litigated disputes concerning federal and state constitutional law, including the Commerce and Due Process Clauses.
Mr. Shargel also represents individuals and companies in criminal and regulatory investigations involving securities laws and municipal laws.
As part of his pro bono practice, Mr. Shargel has assisted injured combat veterans in connection with disability benefit proceedings.
Mr. Shargel joined Bracewell & Giuliani after serving as a law clerk to the Hon. Richard M. Berman of the U.S. District Court for the Southern District of New York.
Lead associate representing multinational travel agency in connection with contract claims arising out of an Exclusivity Agreement.
Lead associate representing internet retailer challenging the constitutionality of a recently-enacted New York State tax statute.
Lead associate representing litigants in arbitration and enforcement proceedings before the Financial Industry Regulatory Authority (FINRA).
Member of team representing private equity fund and its affiliates in several actions involving a Brazilian cargo airline, now in bankruptcy reorganization in Brazil.
Lead associate in the representation of a multinational bank in connection with various investigations conducted by the Department of Justice, the Securities and Exchange Commission and FINRA. Representation also involved assisting bank with its response to third-party subpoenas issued by private litigants.
Lead associate in the representation of a high-ranking elected official in Long Island, New York, in connection with District Attorney's municipal corruption probe, resulting in no charges.
Member of team that represented Fortune 200 company in connection with internal investigation, criminal and regulatory inquiries concerning stock options backdating resulting in no monetary penalties.
