Colleen Higgins Schultz focuses her practice on representing management in all aspects of employment and labor law, including the litigation and arbitration of matters involving employment discrimination, wrongful termination, harassment, retaliation, occupational safety and health, wage and hour disputes, union disputes and employment-related torts. Ms. Higgins Schultz also assists clients with drafting employment agreements and developing employment policies, programs and handbooks that comply with federal and state law.

Representative Matters

Represented employers in numerous OSHA cases including multiple OSHA fatality investigations and one of the largest OSHA cases in US history.

Took and defended dozens of depositions in 1800 plaintiff FLSA collective action.

Defended a variety of federal and state motion practice and litigation matters at trial court and appellate levels involving Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA), Chapter 21 of the Texas Labor Code and Chapter 451 of the Texas Labor Code.

Represented employers in several union and nonunion arbitration cases.

Counseled and advised clients on the formulation and implementation of preventative labor and employment strategies, policies and procedures.

Handled dozens of federal and state agency employment discrimination investigations and unfair labor practice charges.

Drafted many employment agreements, dispute resolution programs, safety programs and policies, separation agreements, non-competition agreements, settlement agreements, handbooks and employment policies.

Rendered legal advice and opinions on a variety of issues including employee discipline and discharge.
