Brian Nash is an associate in Bracewell & Giuliani's IP litigation group. His practice focuses on patent and intellectual property litigation and counseling, with experience in the areas of semiconductors and electronic devices. Mr. Nash has particular experience in Section 337 Investigations before the International Trade Commission, having taken two cases to trial with favorable results.
Previously, Mr. Nash served as a Law Clerk to Judge Richard Linn of the U.S. Court of Appeals for the Federal Circuit.
Representative Matters
In the Matter of Certain Devices Having Elastomeric Gel, Inv. No. 337-TA-732. Represented device manufacturer in pursuing a Section 337 investigation for patent infringement against over 25 respondents.
Certain Integrated Circuits, Chipsets, and Products Containing Same Including Televisions, Media Players, and Cameras, ITC Inv. No. 337-TA-709. Representing Complainant Freescale Semiconductor, Inc.
Neon Enterprise Software, LLC v. International Business Machines Corp., - (W.D. Tex.) Representing Neon Enterprise Software in an antitrust case against IBM.
Certain Mobile Telephones and Wireless Communication Devices, Inv. No. 337-TA-663. Represented LG Electronics in defending against two image processing patents. Managed key aspects of case from institution to post-trial, including expert selection and preparation, discovery, non-infringement and invalidity expert reports, dispositive and discovery motions, pre-trial and post-trial briefs, witness preparations, and trial preparations. Took and defended over a dozen depositions of expert, fact, and corporate-designated witnesses.
Certain Liquid Crystal Display Devices and Products Containing the Same, Inv. No. 337-TA-631. Represented Samsung Electronics in enforcing four patents related to liquid crystal displays. Managed key aspects of case from pre-suit to post-trial, including expert selection and preparation, discovery, infringement and validity expert reports, dispositive and discovery motions, pre-trial and post-trial briefs, witness preparations, trial preparations, and Commission review. Won exclusion order against all Sharp LCD televisions based on the wide-viewing angle patent.
Sharp Corp. v. Samsung Electronics, Eastern District of Texas. Represented Samsung Electronics in an action involving ten patents related to liquid crystal displays. Managed key aspects of the case, including expert selection, prior art searches and selection, and strategy for defending against a substrate fabrication patent. Resulted in a favorable outcome for our client.
