Paul W. Fox heads the Bracewell & Giuliani LLP power practice, is energy liaison to the firm's special matters and internal investigations team, serves as co-head of the energy and telecommunications practice, and is serving his second term on the firm's management committee. Mr. Fox counsels and represents domestic and foreign electric and natural gas companies on matters dealing with competition, open access, convergence, ratemaking, restructuring and regulatory compliance, in transactions, investigations and enforcement.

Mr. Fox has 35 years of experience litigating complex, multi-party proceedings before the Federal Energy Regulatory Commission (FERC), the Department of Energy (DOE), the Bonneville Power Administration, federal appellate courts and arbitration tribunals in the U.S. and Canada. Mr. Fox has also appeared before the National Energy Board of Canada, the British Columbia Utilities Commission and the Public Utility Commission of Texas.

Particularly credentialed in cross-border energy trade with Canada, he advises on gas import and export and electricity trade in bilateral and organized markets throughout the Western Energy Coordination Council region, and has extensive experience with hydropower systems. His practice includes issues arising under the North American Free Trade Agreement, the Foreign Sovereign Immunities Act and various international treaties.

Representative Matters

Represented major Canadian electric utilities and its power marketing subsidiary in complex, multi-party litigation before the FERC, the DOE and federal appellate courts, and in investigations by the FERC and Commodities Futures Trading Commission, arising from the California Power Crisis of 2000-2001.

Advised power sellers with respect to market-based rate and open access transmission issues, including participation in FERC rulemakings and transmission and arbitration proceedings before the Bonneville Power Administration.

Represented Canadian natural gas aggregators and exporters in pipeline restructuring and open access proceedings before FERC.

Represented natural gas and electricity importers and exporters on cross-border trade issues before the FERC and DOE, including North American Free Trade Act and treaty issues.
