Eduardo S. Pérez represents and counsels clients in civil litigation matters, primarily involving environmental torts, state and federal environmental law, and products liability. His experience includes extensive work on a nationwide, multi-district litigation involving alleged groundwater contamination by the gasoline additive MTBE.

Mr. Pérez also has represented corporate clients as plaintiffs in cases involving both indemnification for historical contamination of property, and diminution in property value and business damages stemming from migration of contaminants from neighboring properties.

Mr. Pérez has 12 years of oil-industry experience, having held several positions in a major oil company's downstream business prior to joining Bracewell & Giuliani LLP. This experience includes approximately six years in the company's health, safety and environment department, during which Mr. Pérez developed a strong background in the technical and scientific issues involved in soil and groundwater gasoline contamination matters.

Representative Matters

Currently representing Valero Energy Corporation and TOTAL PETROCHEMICALS USA INC. as national counsel in more than 60 MTBE contamination and product defect cases consolidated in MDL 1358 in the United States District Court, Southern District of New York.

The Goodyear Tire & Rubber Company, et al. v. Minstar Inc., et al.; In the 134th Judicial District Court of Dallas County, Texas. Successfully represented the Goodyear Tire & Rubber Company and Retreading L Inc. in a contractual indemnification matter relating to remediation of historical contamination of industrial property.

Impact Plastics Inc., et al. v. Nuclear Fuel Services Inc.; United States District Court for the Eastern District of Tennessee at Greeneville. Successfully represented Impact Plastics Inc. achieving a favorable settlement in a case involving diminution of property value and business damages related to contamination of industrial property from neighboring nuclear facility.
