David C. Albalah heads Bracewell & Giuliani LLP’s New York office bankruptcy and financial restructuring section. Mr. Albalah advises special situation funds and creditors’ committees, represents debtors and creditors on bankruptcy and insolvency, and counsels purchasers of assets and providers of funding to distressed companies. Mr. Albalah also represents financially troubled companies in connection with the restructuring of their indebtedness under Chapter 11 of the Bankruptcy Code, parties-in-interest in Chapter 11 bankruptcy cases, and landlords in lease acquisitions out of bankruptcy. He has extensive experience in the litigation of complex commercial matters in state courts, bankruptcy courts, federal district courts, and the United States Circuit Courts of Appeal, including several published opinions.
Mr. Albalah serves as outside corporate and trial counsel and strategic adviser to a number of publicly traded and privately held corporate clients in the telecommunications, entertainment and financial services industries. He provides guidance with regard to corporate governance, financings, mergers, acquisitions and litigation.
Mr. Albalah leads our Alternative Dispute Resolution practice and is a member of the mediation panel of the U.S. Bankruptcy Court for the Southern District of New York and the U.S. Bankruptcy Court for the District of New Jersey, and has served as a court-appointed mediator in various matters. As a certified public accountant, Mr. Albalah gained audit and tax experience at a Big Four accounting firm before he entered law school. He currently serves as an adjunct professor of law at Rutgers University School of Law.

Bankruptcy
Represented many financially troubled companies in connection with the restructuring of their indebtedness under Chapter 11 of the Bankruptcy Code, including Brentano's, Caldor, Coated Sales, Coda Acquisition, Commodore, Fishers Big Wheel, Gaston & Snow, Hills Department Stores, Houbigant, Jamesway, Keren Limited Partnership, Labels for Less, Laventhol & Horwath, LTV, OAN Services and Yatzkan Rehabilitation Center.
Represented parties-in-interest in many of the major Chapter 11 bankruptcy cases, including Adelphia, Ames, Enron, Federal Mogul, Global Crossing, K-Mart, Loral, MCI, MFN, Owens Corning, PT-1, RSL, Sharp, Teleglobe, Warnaco, Winstar and World Access.
Represents official and unofficial creditors' and equity holders' committees, significant creditors in connection with Chapter 11 cases and out-of-court restructurings of companies including Gaston & Snow, Jamesway and Pacific Gateway.
Represents lenders to financially distressed companies and provides corporate finance, strategic planning and debtor-creditor advice to a number of clients, including Daiwa, IBJ, IDT Corporation and OAN Services.
Represented entities that purchase assets out of bankruptcy, including Balfour, Blue Streak, Consolidated Auctioneers, Goldman Sachs, HIG, Houbigant, IDT Corporation, Jordan Industries, KVP LP, Kimble Group, Little Bear, Morgan Stanley, Net2Phone and Nexell Therapeutics.
Represented landlords in lease acquisitions out of bankruptcy, including G & G Retail, Jimmy Jazz, KVP, Mother's Work and Wilson's Leather.
Corporate and Litigation
Represented clients in corporate transactions, including IDT Corporation, JCOR, Kushner, Net2Phone, Suarez, Seneca One and Parrhill Companies.
