Lon Williams and Wendell Washington will present the seminar on "Recent Developments in Texas Non-Compete Law."

Program Description
In late 2006, the Texas Supreme Court ended years of confusion and ruled that non-compete agreements do not require that employers immediately provide an employee with confidential information to make the agreement binding. In Alex Sheshunoff Management Services L.P. v. Kenneth Johnson, the Court made it easier for the state's employers to write, implement and enforce at-will employee contracts that contain binding non-compete clauses.

Discussion will include:

  • The shift away from an emphasis on timing to an emphasis on drafting terms which protect legitimate business interests
  • The elements of an enforceable agreement under the new ruling
  • Drawing the right lessons from Sheshunoff
  • The long-term impact of the ruling on non-compete claims
