Program Description
The “rule of capture” has officially applied to allocation of Texas groundwater since 1904. While underground water conservation districts have begun to regulate the size and density of wells, the rule of capture essentially means the person with the “largest straw” wins the water.

Recent cases involving private landowners are beginning to challenge this law. This presentation will discuss the laws relating to the ownership and regulation of groundwater in Texas, protecting groundwater rights, drafting water agreements, reserving groundwater rights, and the increasing value of groundwater in the state.
